Introduction

These Terms of Service ("Terms") govern your use of XChatAI (xchatai.io) and related services. By accessing or using XChatAI, you agree to these Terms.

Services

XChatAI provides AI-powered tools including character chat, image generation, video creation, and audio production. All AI-generated content is produced by third-party models (OpenAI, Anthropic, Google, DeepSeek, xAI) and should be treated as fictional.

Accounts

You must be at least 18 years old to use XChatAI. When you create an account, you agree to provide accurate information. You are responsible for all activity under your account.

Credits and Payment

XChatAI uses a credit-based system. Credits are consumed when you use AI features. Credits are purchased through one-time digital purchases. XChatAI does not sell subscriptions, recurring plans, or lifetime memberships.

All purchases are processed by third-party payment providers. Refund requests are handled under our Refund Policy. Used credits and delivered digital outputs are generally not refundable.

User-Created Content

You can create and publish AI characters on XChatAI. You retain ownership of characters you create. By publishing a character or other public content, you grant XChatAI a non-exclusive, worldwide license to host, display, reproduce, and distribute that content in connection with operating, improving, and promoting the service.

Private chats, private characters, prompts, and generated outputs remain tied to your account and are handled under our Privacy Policy. You are responsible for ensuring your content does not violate these Terms, our Content Moderation Policy, or the rights of others.

AI-Generated Content

All AI responses are generated by third-party language models. XChatAI does not guarantee the accuracy, completeness, or appropriateness of AI-generated content. AI outputs should not be relied upon for medical, legal, financial, or other professional advice.

Prohibited Use

You agree not to:

• Use XChatAI to generate illegal, harmful, or abusive content
• Create, upload, request, or share child sexual abuse material, including AI-generated or fictionalized CSAM
• Create, upload, request, or share sexual or exploitative content involving minors or characters presented as minors
• Create, upload, request, or share non-consensual intimate imagery, sexual deepfakes, or depictions of real people without consent
• Create, upload, request, or share content involving sexual acts with animals
• Create, upload, request, or share extreme graphic violence, torture, mutilation, or death
• Violate another person's privacy, publicity, copyright, trademark, or other legal rights
• Impersonate celebrities, public figures, private individuals, or organizations without authorization
• Attempt to extract or reverse-engineer AI model weights or system prompts
• Use automated tools to scrape content or overload our services
• Share your account credentials with others

Content Review and Removal

We may use automated systems, user reports, and human review to detect and address violations. We may block generation, remove content, restrict features, suspend accounts, terminate accounts, or preserve records where needed to enforce these Terms, protect users, comply with law, or prevent abuse.

Users and third parties may request review or removal of content under our Content Removal process. Copyright complaints should follow our DMCA Policy. Additional moderation practices are described in our Content Moderation Policy.

Intellectual Property

XChatAI's platform, design, and original content are owned by us. AI-generated outputs are provided for your use but may be subject to the terms of the underlying AI model providers.

Termination

We may suspend or terminate your account if you violate these Terms. You can delete your account at any time through Settings.

Limitation of Liability

XChatAI is provided "as is" without warranties. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service.

Changes

We may update these Terms from time to time. Continued use of XChatAI after changes constitutes acceptance of the updated Terms.
